Terms & Conditions of Use and Sale of Goods


Definitions

“allyourprotein.co.uk”, “We”, “our” – means Honest Supplements Ltd, company No. 08981369 registered address. 62 Parr Street, Howley, Warrington, WA1 2JN.
“Use” and “you”- means any user of the website including any user who makes a purchase through the website (a “Buyer”)
1. General
1.1 This agreement applies between you, the user of this Website including any user who makes a purchase through the website (a “Buyer”) and allyourprotein.co.uk the trading name of Honest Supplements Ltd, company No. 08981369 registered address. 62 Parr Street, Howley, Warrington, WA1 2JN. Your agreement to comply with and be bound by clause 2-7 of these terms & conditions is deemed to occur upon your use of the website. Clauses 8-20 apply to the sale of goods. Clause 21 applies to promotional competitions we may hold.
1.2 By accessing, using or placing an order on the website you accept and agree to be bound by these terms and conditions.
1.3 allyourprotein.co.uk reserves the right to change or remove (temporarily or permanently) the website (or any part of it) without notice to you and confirm that we will not be liable to you for any such change or removal. We reserve our right to change these terms and conditions at any time without prior notice, your continued use of the web site following any change shall be deemed to be your acceptance of such change. It is your responsibility to check the terms & conditions regularly for changes and prior to submitting an order; if you do not agree to the terms & conditions you must immediately stop using the website. Such Change however will have no effect on orders that were accepted before the changes were made to the terms & conditions.

2. Links

We may provide links to other websites. Any such link is not under our control and we assume no responsibility for the availability of and content on such website or resources. We disclaim any liability for any and all forms of loss and damage arising out of the use of them. The inclusion of a link to another site on this website is not an endorsement of the website or the resources.

3. Intellectual Property

3.1 You acknowledge and agree that all intellectual property rights including but not limited to copyright and trademarks in all material on the website, the website content including but not limited to design, layout, structure , graphics, software and source codes connected with the website shall remain at all times vested in us or our licensors. You are only permitted to use this material as expressly authorised by us.
3.2 You acknowledge and agree that the material contained within the website is available for your personal non-commercial use only. You may only access, view, copy and/or print material from the website for the sole purpose of you evaluating whether to and/or placing an order with us. Any other use of the website material is strictly prohibited by using the website you acknowledge that such material is protected by applicable United Kingdom, International intellectual property and other laws.


4 Limitation of Liability

4.1 The website is provided to you on an “as is” and “as available” basis without any warranty being given in relation to the website including but not limited to implied warranties of non-, compatibility, security, accuracy or any implied warranty arising from course of dealing or usage or trade.
4.2 We make no warranty that the website will meet your requirements or will be interrupted, timely or error-free, that defects will be corrected or that the site or the server(s) that make it available are free of viruses or bugs.
4.3 We will not be responsible or liable to you for any loss of material uploaded or transmitted through the website.
4.4 We will not be liable in contract, tort, negligence, for pre-contract or other representations (other than fraudulent or negligent representations) or otherwise out of or in connection with these terms & conditions of use for any: economic loss (including but not limited to loss of revenues, profits, contracts, business or anticipated savings) ; or any special or indirect losses whatsoever. You should be aware that you use the website at your own risk.
4.5 Nothing in these terms & conditions of use shall exclude or restrict liability for death or personal injury resulting from our negligence or that of our agents or employees

5 Indemnity

You agree to fully indemnify, defend and hold us, our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including legal fees, arising out of any breach of these terms & conditions of use by you or other liabilities arising out of your use of the website.

6 Severance
Each part of these terms & conditions of use shall be interpreted separately and independently of each other and the validity of any one part shall not affect the validity and enforceability of any other part.

7 Law and Jurisdiction

These terms & conditions of use and the relationship between you and us shall be governed by the laws of England & Wales and you agree to submit to the exclusive jurisdiction of the courts of England & Wales.

8.2 All orders for goods made by you and accepted by allyourprotein.co.uk are subject exclusively and strictly to these terms & conditions of trade.

9 Ordering

9.1 All orders made by you are subject to acceptance by us. We reserve the right not to accept your order for any reason.
9.2 You may place an order by completing the order process through the website or by calling allyourprotein.co.uk between the hours of 9.00 am – 17.00 pm GMT (Mon-Fri) and 10.00 am – 16.00 pm GMT (Sat).
9.3 If we accept your order we will notify you of our acceptance by issuing an order confirmation to you by e-mail. The order confirmation will be effective as of the date on which the order confirmation is sent to you. If we cannot accept your order we will attempt to contact you by e-mail, telephone or post.
9.4 If the goods you have ordered are not available from stock we will contact you by e-mail and you will have the option to:
Wait until the goods are available from stock
Cancel your order in accordance with our cancellation & returns policy

10 Description of Goods & Prices

10.1 After we receive your order, we will confirm by e-mail the details, description and price for the items you have chosen. If these differ from the details, description and/or price shown on the website and you wish to cancel your order you may do so in accordance with our cancellation & returns policy.
10.2 All details, descriptions and prices for the goods appearing on the website are correct at the time the information was in-putted. You should check the condition of any received goods on arrival to ensure that they are not faulty.
10.3 Sale prices and promotions are only valid for the specified period.
10.4 We reserve the right to adjust the price and specification of any item on the web site at our discretion.
10.5 We reserve the right to withdraw any items from the website at any time.
10.6 We will not be liable to you or anyone else for withdrawing any items from the website or refusing to process an order.
10.7 All prices are inclusive of VAT.

11 Age of Consent

11.1 If you wish to order goods which may only be purchased by persons of a certain age you will be asked when placing an order to declare that you are of the appropriate legal age to purchase the items.
11.2 If we discover that you are not legally entitled to order certain goods, we reserve the right to terminate all your account facilities immediately, without notice and we will not be obliged to complete the order.

12 Payment & VAT

12.1 The total cost of your order is the price of the goods plus card processing and delivery charges as set out in the deliveries section and will be confirmed to you prior to the completion of the order. All credit card payments are processed for you by worldpay and are then paid to us.
12.2 Payment can be made by most major credit or debit cards in accordance with our payment methods. Payment will be debited from your account upon processing your order with us.
12.3 You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment, we will not be liable for any delay or non-delivery and we are not obliged to inform you of the refusal.
12.4 We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment.
12.5 The price for the goods as set on the website includes VAT for EU deliveries. We are not responsible for any other importation taxes, sales taxes or charges that may be levied at the delivery destination.

13 Delivery & Risk

13.1 We dispatch items ordered to you as they are available using approved couriers, delivery charges are as set out in the delivery section. The approved courier will attempt to deliver your parcel and will request a signature; if for any reason the courier cannot attain a signature at the requested delivery address they will leave your parcel safe with a neighbour or in a safe place if specified by you. A card will be placed through the requested delivery address stating the destination of your parcel.
13.2 Orders will be sent to the delivery address that you have registered or specified in your order. We cannot be held responsible if this delivery address is wrong. If you wish to change your delivery address and the order has been accepted you must contact the customer services team as detailed previously; please note a charge is likely to be incurred.
13.3 We will use our reasonable endeavours to ensure that the estimated delivery times set out in the deliveries section but do not accept any liabilities for late deliveries.
13.4 On occasion items may be lost in the post. If this occurs you must follow instructions in the Goods Lost in Post Section.
13.5 Alternatively for local customers goods can be collected from allyourprotein.co.uk registered address. If you choose this option we will contact you when goods are available to make arrangements for their collection. Items can be collected between the hours of 9.00 am – 17.00 pm GMT (Mon-Fri) and 10.00 am – 16.00 pm GMT (Sat) from our registered address.
13.6 In order to verify identification for delivery a copy of the order confirmation must be brought along with the card used for payment or photo identification. Collection of goods will not be permitted without these items.
13.7 Once the goods have been delivered or collected all risk of damage to, or loss of, the goods shall pass to you. If you intend to cancel your order in accordance with the cancellation & returns policy, you must keep good care of the goods pending their return to us.
13.8 Your order may flag up on our security system if the card is not registered to the address you give. If this occurs we will seek further proof before order dispatch.

14 Limitation of Liability

14.1 To the fullest extent permissible under law, we disclaim any and all warranties of any kind (whether express or implied) in relation to goods purchased by you through the website your statutory rights as a consumer are not affected.
14.2 Our liability in contract, tort, negligence, pre-contract or other representations or otherwise arising out of or in connection with these terms & conditions of sale of goods shall be limited in aggregate to all sums paid by you to us.
14.3 In any event, we shall not be liable to you under, or in connection with these terms & conditions of trade in contract, tort, negligence, pre-contract or other representations (other than fraudulent or 14.4 negligent representations) or otherwise for any economic loss (including without limitation loss of revenues, profits, contracts, business or anticipated savings) or for any special or indirect losses whatsoever.
14.4 Nothing in these terms & conditions of trade shall exclude or limit liability for death or personal injury resulting from our negligence or that of our agents or employees.

15 Cancellation, Returns and Delivery

15.1 You have 7 calendar days to return items bought through the website or cancel the order to obtain a refund of the price of the returned items. To return items or cancel an order to receive a refund you must contact us by phone, e-mail or in writing and follow our procedure for returning items.
15.2 Any order errors must be reported to us within 48 hours of delivery; no exchange of product can be authorised after this period.
15.3 You will be refunded through the payment method used by you when purchasing the items. You are fully responsible for paying shipment costs of returned items.
15.4 Items must be returned in their original condition with all packaging as received with the product unopened ready to re-sell with all accompanying documentation.
15.5 Refunds will be issued typically within 7 days from receipt of returned items and in any event no later than 30 calendar days after receipt of the returned items and will include standard delivery charges. We regret that additional costs such as express delivery and gift-wrapping cannot be refunded.
15.6 All returned orders received following unsuccessful delivery will be charged at £ 5.50 to be resent to customers. Any non-collected consignments will be charged at £ 5.50.
15.7 Any order refused on delivery will be charged at a standard rate of £ 20.00
15.8 Delivery via our approved courier will be attempted twice, third time deliveries will be charged at £ 4.00. A change of address following the order being made will be charged at £ 12.00

16 Goods Lost in Post

The majority of orders are delivered on time, unfortunately on occasion items may go missing. Please see below the procedure to follow if you suspect that an item we have sent is lost in transit.
Failure to follow the procedure may result in a considerably longer resolution time.
Allow 7 working days from date of dispatch. We will have sent you an e-mail confirming your order number and when the item(s) has/have been dispatched and by which approved courier.
If we are delivering via Royal Mail contact your local sorting office to make sure they are not holding items for you.
Make a note of the details such as who you have spoken to and when.
If the sorting office, neighbours etc. have not got the parcel please contact us.
If we are delivering with an approved courier other than Royal Mail. Following any tracking information you may have received automatically, attempt to track the parcel online following the approved courier procedure or contact your courier to make sure they are not holding items for you.
Make a note of the details such as who you have spoken to and when.
Should you be unable to track the item or an issue has been highlighted please contact us.
Claims will be processed within 1-2 days and pending information received during the claim investigation period, replacement items will be sent out.
If you want replacement goods to be sent, you must contact us within 30 days of your order being dispatched.
We will not send replacement goods unless the above procedure has been followed.

17 Security & Privacy

You should review our security & privacy policy (which, for the avoidance of doubt do not form part of the terms & conditions). If you have entered an e-mail, we may send you special offers. If you wish for these to stop please click the unsubscribe option on the e-mail.

18 Changes to these Terms & Conditions of the sale of goods

We may change these terms & conditions of the sale of goods at any time.

19 Severance

21 Promotional Terms & Conditions

These rules are set out for competitions on social networks, or across any marketing material we have on display.
21.1 Competitions are held at our discretion- prizes offered have no alternative, in product or cash value.
21.2 Any staff members or close family members cannot participate in competition. Staff members from our suppliers are also prohibited from entering.
21.3 Winners will be chosen at random.
21.4 Prizes will be dispatched within 7 days after the winner is announced.
21.5 There are no returns on prizes.
21.6 We reserve the right to suspend a competition at any time, even after posting the competition.
21.7 Winners will be announced and contacted depending on the competition.
21.8 If the winner does not respond within 7 days of being contacted, the prize will be void.
